1. Terms of Use

1.1. This user agreement (hereinafter referred to as the Agreement) is an offer of terms for using the website http://fortnoks.estate (hereinafter referred to as the Site), by the Site Administration and an individual (including representatives of legal entities) (hereinafter referred to as the User), which regulates the conditions for the User to provide information for placement on the Site.

1.2. A User of the Site is considered any individual who has ever accessed the Site and who has reached the age permissible for accepting this Agreement.

1.3. The User must fully read this Agreement before registering on the Site. The User's registration on the Site implies full and unconditional acceptance of this Agreement by the User. If the User disagrees with the terms of the Agreement, they must immediately cease using the Site.

1.4. This Agreement may be amended and/or supplemented by the Site Administration unilaterally without any special notification. These Rules are an open and publicly accessible document.

1.5. The Agreement implies mutual rights and obligations of the User and the Site Administration.

2. Procedure for Using the Site

2.1. The Site allows the User to view and download information from the site solely for personal, non-commercial use. Modifying site materials, distributing them for public or commercial purposes is prohibited.

2.2. When registering on the site, the User agrees to provide accurate and truthful information about themselves and their contact details.

2.3. During registration on the site, the User provides personal information that is processed by the Site Administration in accordance with the Privacy Policy.

2.4. The User may contact the Site Administration with questions, claims, suggestions for improving work, or with any other information. The User is responsible for ensuring that this contact is not illegal, threatening, infringing on intellectual property rights, discriminating against people for any reason, contains insults, or otherwise violates the current laws of Ukraine.

3. User Personal Information

3.1. The Site Administration respects and responsibly treats the confidential information of any person who has become a visitor of this site. By accepting this Agreement, the User consents to the collection, processing, and use of certain information about the User in accordance with the provisions of the Law of Ukraine "On the Protection of Personal Data" and the Site Administration's rules on the protection of personal data. Additionally, the User agrees that the Site Administration may collect, use, transfer, process, and maintain information related to the User's account to provide relevant services.

3.2. The Site Administration agrees to collect only that personal information which the User provides voluntarily when such information is needed to provide (improve) services to the User.

3.3. The Site Administration collects both primary personal data, such as name, surname, middle name, address, and email address, as well as secondary (technical) data – cookies, connection information, and system information.

3.4. The User agrees that the confidentiality of data transmitted over the Internet is not guaranteed if third parties gain access to these data outside the technical means of communication under the Site Administration's control. The Site Administration is not responsible for any damage caused by such access.

3.5. The Site Administration may use any information collected through the Site to improve the content of the website, enhance its features, transmit information to the User (upon request), for marketing or research purposes, and for other purposes that do not contradict the provisions of the current legislation of Ukraine.

4. Prohibited on the Site:

4.1. Calls for violent change or overthrow of the constitutional order or seizure of state power; calls for changing the administrative boundaries or state border of Ukraine, violating the order established by the Constitution of Ukraine; calls for riots, arson, property destruction, seizure of buildings or structures, violent eviction of citizens; calls for aggression or the initiation of a military conflict.

4.2. Direct and indirect insults to anyone, including politicians, officials, journalists, resource users, including based on national, ethnic, racial, or religious affiliation, as well as chauvinistic statements.

4.3. Obscene expressions, statements of a pornographic, erotic, or sexual nature.

4.4. Any offensive behavior towards authors of articles and all participants of the resource.

4.5. Statements intended to deliberately provoke a sharp reaction from other resource participants.

4.6. Advertising, commercial messages, as well as messages that lack informational load and do not relate to the subject of the resource, if such advertising or messages do not have special permission from the Site Administration.

4.7. Any messages and other actions prohibited by the laws of Ukraine.

4.8. Impersonating another person or a representative of an organization and/or community without sufficient rights, including for employees and owners of the Site, as well as misleading about the properties and characteristics of any subjects or objects.

4.9. Posting materials that the User does not have the right to make available by law or under any contractual relationships, as well as materials that infringe any patent, trademark, trade secret, copyright, or other proprietary rights and/or related rights of third parties.

4.10. Posting unauthorized advertising information, spam, pyramid schemes, "chain letters"; materials containing computer codes designed to disrupt, destroy, or limit the functionality of any computer or telecommunications equipment or software, to carry out unauthorized access, as well as serial numbers to commercial software products, logins, passwords, and other means for obtaining unauthorized access to paid resources on the Internet.

4.11. Deliberate or accidental violation of any applicable local, state, or international laws.

5. Limitation of Liability of the Site Administration

5.1. The Site Administration is not responsible for any errors, typographical errors, or inaccuracies that may be found in the materials contained on this Site. The Site Administration makes every effort to ensure the accuracy and reliability of the information provided on the Site.

5.2. Information on the Site is constantly updated and may become outdated. The Site Administration is not responsible for receiving outdated information from the Site, as well as for the User's inability to receive updates of the information stored on the Site.

5.3. The Site Administration is not responsible for the statements and opinions of the visitors of the site, left as comments or reviews. The opinion of the Site Administration may not coincide with the opinion and position of the authors of reviews and comments. At the same time, the Site Administration takes all possible measures to prevent the publication of messages that violate the current legislation or moral norms.

5.4. The Site Administration is not responsible for any unlawful actions of the User towards third parties or third parties towards the User.

5.5. The Site Administration is not responsible for the statements made by the User published on the Site.

5.6. The Site Administration is not responsible for any damages, losses, or expenses (real or possible) arising in connection with this Site, its use, or the inability to use it.

5.7. The Site Administration is not responsible for the loss by the User of the ability to access their account on the Site.

5.8. The Site Administration is not responsible for incomplete, inaccurate, incorrect indication of data by the User when creating a User account.

5.9. If there are problems in using the Site, disagreement with specific sections of the User Agreement, or if the User receives inaccurate information from third parties, or information that is offensive in nature, any other unacceptable information, please contact the Site Administration so that the Site Administration can analyze and eliminate defects, restrict and prevent the receipt of unwanted information on the Site, and if necessary, restrict or terminate the obligations to provide their services to any User and client who intentionally violates the provisions of the Agreement and the functioning of the Site.

5.10. For the purposes stated above, the Site Administration reserves the right to delete information posted on the Site and take technical and legal measures to terminate access to the Site by Users who, according to the conclusion of the Site Administration, create problems in using the Site by other Users, or Users who violate the requirements of the Agreement.

6. Agreement Validity Procedure

6.1. This Agreement is a contract. The Site Administration reserves the right to change this Agreement as well as to introduce a new one. Such changes take effect from the moment they are posted on the Site. The use of the Site materials by the User after the change of the Agreement automatically means their acceptance.

6.2. This Agreement becomes effective from the first visit to the Site by the User and is valid between the User and the Company for the entire period of use of the Site by the User.

6.3. The Site is an object of intellectual property rights of the Site Administration. All exclusive copyright rights to the Site belong to the Site Administration. The use of the Site by Users is possible strictly within the framework of the Agreement and the legislation of Ukraine on intellectual property rights.

6.4. All trademarks and names referenced in the materials of this Site are the property of their respective owners.

6.5. The User agrees not to reproduce, duplicate, copy any parts of the Site, except when such permission is given to the User by the Site Administration.

6.6. This Agreement is governed and interpreted in accordance with the laws of Ukraine. Issues not regulated by the Agreement shall be resolved in accordance with the legislation of Ukraine.

Protection of Personal Data

Dear User, by registering on our site or using various services of our site that require entering your personal data, you consent to the processing of your personal data in accordance with the Law of Ukraine "On the Protection of Personal Data," as well as the agreed and approved Rules. The Site Administration reserves the right to use this information for marketing purposes within the framework of providing services.

You consent to the Site owner performing actions in the information (automated) system and/or in personal data card files related to the collection, registration, accumulation, storage, adaptation, modification, updating, use, and distribution (realization, transfer), anonymization, and destruction of relevant personal data and information about you as an individual.
